Catchdex Terms of Use

Welcome to Catchdex. By downloading or using the app, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the app. These Terms are written in plain language — no legal degree needed.

1. IMPORTANT DISCLAIMERS — PLEASE READ FIRST

Catchdex helps identify fish from photos. A wrong identification can be dangerous. Please read this section carefully before you use the app.

A. NEVER USE IDENTIFICATION RESULTS FOR FOOD. THE IDENTIFICATION RESULTS, ENCYCLOPEDIA CONTENT, AND ANY OTHER INFORMATION PROVIDED BY THE APP ARE FOR GENERAL REFERENCE ONLY. THEY MUST NEVER BE USED AS THE BASIS FOR EATING, COOKING, BUYING, SELLING, OR OTHERWISE CONSUMING ANY FISH OR OTHER ORGANISM. SOME FISH ARE POISONOUS, AND MISTAKES CAN CAUSE SERIOUS INJURY OR DEATH. WHEN IN DOUBT, ASK A LOCAL EXPERT AND RELY ON OFFICIAL SOURCES.

B. NOT LEGAL OR REGULATORY ADVICE. THE APP DOES NOT PROVIDE LEGAL, REGULATORY, OR FISHING-ADVICE. FISHING LAWS (SIZE LIMITS, BAG LIMITS, SEASONS, PROTECTED SPECIES, LICENSES, AND AREA RESTRICTIONS) DIFFER BY LOCATION AND CHANGE OVER TIME. YOU ARE ALONE RESPONSIBLE FOR FOLLOWING THE LAWS THAT APPLY TO YOU.

C. HANDLING FISH IS AT YOUR OWN RISK. THE APP DOES NOT PROVIDE GUIDANCE ON HANDLING, RELEASING, OR DISPOSING OF LIVE FISH. CATCHING, TOUCHING, OR RELEASING FISH INVOLVES RISKS (SUCH AS SHARP SPINES, TEETH, SLIME, OR PATHOGENS). YOU ASSUME ALL SUCH RISKS YOURSELF.

D. COOKING AND HANDLING NOTES ARE NOT RECOMMENDATIONS TO EAT. THE SPECIES ENCYCLOPEDIA MAY INCLUDE HANDLING NOTES, EDIBILITY INFORMATION, OR COOKING SUGGESTIONS FOR SOME SPECIES. THESE ARE GENERAL REFERENCE ONLY AND ARE NOT A RECOMMENDATION, GUARANTEE, OR ENDORSEMENT THAT ANY FISH IS SAFE OR SUITABLE TO EAT, COOK, OR BUY. SOME FISH CARRY TOXINS, PARASITES, OR CONTAMINANTS THAT CAN CAUSE SERIOUS ILLNESS. YOU — NOT THE APP — ARE RESPONSIBLE FOR ANY DECISION TO EAT OR SERVE ANY FISH, AND YOU MUST VERIFY SAFETY WITH OFFICIAL SOURCES AND LOCAL AUTHORITIES.

These disclaimers are repeated inside the app. They are not suggestions — they are conditions of using Catchdex.

2. Eligibility and age

You must be at least 13 years old to use Catchdex.
If you are between 13 and 18, you need a parent or guardian's permission to use the app.
By using Catchdex, you confirm that you meet these requirements and that your use complies with the laws of your location.

3. The service and AI results

Catchdex identifies fish using artificial intelligence. AI is not perfect. Results may occasionally be wrong, especially for young fish, rare species, or poor-quality photos.
We do our best to keep the app available, but we may update, change, or pause features at any time, with or without notice.
Catchdex currently offers a free quota: 10 identifications per device per month. Identifications that do not result in a successful match do not consume a credit — up to 5 unsuccessful matches per device per month are free; beyond that, unsuccessful matches count toward the monthly quota. When the quota is exhausted, identification requests are declined until the quota resets. We may adjust the quota or introduce paid plans in the future; any such change will be reflected in these Terms and in the app.

4. License and restrictions

We give you a personal, non-exclusive, non-transferable, revocable license to use Catchdex for your own personal, non-commercial purposes. You may not:

Reverse engineer, decompile, or attempt to extract the source code of the app;
Copy, scrape, or redistribute the app's content (including the species encyclopedia) for commercial purposes;
Interfere with, disrupt, or attempt to gain unauthorized access to our servers;
Abuse the free quota (for example, by automating identifications or creating multiple device IDs to bypass limits);
Use the app for any unlawful purpose.

5. Your content and privacy

You keep your rights to your own photos. Catchdex does not claim ownership of the photos you choose to identify.
We do not save your identification photos. Photos are processed in memory and released when identification is complete. See the Privacy Policy for details.
Improving identification accuracy. As part of operating the service, we may keep a small sample (about 5%) of photos you confirm as a catch, and photos our server identifies as containing no fish as negative examples, for 90 days to improve our AI. You grant us a limited license to use those photos only for improving identification accuracy. You can ask us to delete what we collected by emailing support@dagvisio.com.
Photos you attach in the feedback form. If you attach up to 9 photos to a feedback message, we keep them to review your report for up to 90 days, then schedule them for deletion. Location (GPS) and other hidden photo data (EXIF) are removed before storage.
Please do not upload sensitive information. Do not use the identification feature to upload financial account numbers, ID documents, other people's identifiable photos, or health information. We are not responsible for anything you choose to send.

6. Purchases and subscriptions

Current status: there are no purchases or subscriptions in Catchdex. The service is free with a monthly quota.

If paid plans are introduced in the future, we will update these Terms and disclose the pricing in the App Store listing. Payments would be handled by Apple through the App Store; we would not receive your payment card details. Renewals, refunds, and cancellation would follow Apple's policies.

7. Intellectual property

The Catchdex app, its design, the species encyclopedia, and the identification service are owned by the developer. All species illustrations (hero images) are original artwork created for Catchdex and are protected by copyright. No third-party imagery is used in the species encyclopedia.

8. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF IDENTIFICATION RESULTS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IDENTIFICATION RESULTS WILL BE CORRECT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME EXCLUSIONS MAY NOT APPLY TO YOU.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE APP, OR (B) THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW. BECAUSE CATCHDEX IS CURRENTLY FREE, THIS EFFECTIVELY MEANS THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

10. Changes and termination

We may update these Terms from time to time. When we make a material change, we will post the updated version here with a new "Last Updated" date and, when practical, let you know in the app. Your continued use of Catchdex after a change means you accept the updated Terms.

You may stop using Catchdex at any time. We may suspend or terminate your access if you violate these Terms or abuse the service.

11. Governing law and disputes

These Terms are governed by the laws of the developer's jurisdiction, without regard to conflict-of-law rules. We encourage you to contact us first — most issues are resolved with a quick email to support@dagvisio.com. We do not require arbitration, and nothing in these Terms prevents you from seeking remedies before a court with jurisdiction, including small-claims court where available. If you are a consumer in a jurisdiction whose law gives you mandatory protections, those protections are not limited by this section.

12. APPLE'S REQUIREMENTS

If you obtained Catchdex through the Apple App Store, the following applies:

These Terms are between you and the developer only, not Apple.
Apple has no obligation to provide any maintenance or support for the app. If you have questions, contact us, not Apple.
To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app.
If the app fails to conform to any applicable warranty (as described in this section), you may notify Apple, and Apple will refund the purchase price you paid (if any) for the app; beyond that, Apple has no other obligation.
Apple is not responsible for addressing your claims or any third-party claims relating to the app, including product liability, failure to conform to legal or regulatory requirements, or intellectual property infringement.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

13. DMCA / Copyright

We respect intellectual property rights. If you believe content in the app infringes your copyright, send a notice to support@dagvisio.com with:

Your signature (physical or electronic);
Identification of the copyrighted work claimed to be infringed;
Identification of the material claimed to be infringing, and where it is located;
Your contact information (address, phone number, email);
A statement that you have a good-faith belief the use is not authorized; and
A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices in accordance with applicable law (including the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512).

C. 接触鱼类风险自负。 App 不提供活鱼处置、放流或处理指导。垂钓、触摸或放流鱼类存在风险（如尖刺、牙齿、黏液或病原体），一切风险由你自行承担。

D. 烹饪与处理信息不构成食用推荐。 图鉴中可能包含部分鱼种的处理注意事项、可食性信息或烹饪建议。这些仅为一般参考，不构成对任何鱼类安全或适宜食用的推荐、保证或背书。部分鱼类携带毒素、寄生虫或污染物，可能造成严重疾病。是否食用或供应任何鱼类，责任完全在于你，而非 App；你必须通过官方来源与当地主管部门核实安全性。

以上免责在 App 内常驻展示。它们不是建议，而是使用 Catchdex 的条件。

2. 资格与年龄

你必须年满 13 周岁方可使用 Catchdex；
13~18 岁需征得父母或监护人同意；
使用即表示你确认满足上述条件，且使用行为符合你所在地区的法律。

3. 服务与 AI 识别结果

Catchdex 使用人工智能识别鱼类。AI 并非完美，对幼鱼、稀有物种或低质量照片，结果偶尔可能出错。
我们会尽力保持服务可用，但可能随时更新、更改或暂停功能，恕不另行通知。
Catchdex 目前提供免费额度：每设备每月 10 次识别。未成功匹配的识别不消耗次数——每设备每月最多 5 次未成功匹配免计，超出后正常计入。 额度用尽后，识别请求将被拒绝直至额度刷新。我们未来可能调整额度或推出付费计划，届时将同步更新本条款与 App。

4. 许可与使用限制

我们授予你个人、非独占、不可转让、可撤销的许可，用于你个人的非商业用途。你不得：

对 App 进行逆向工程、反编译或尝试提取源代码；
复制、抓取或再分发 App 内容（包括图鉴百科）用于商业目的；
干扰、破坏或尝试未授权访问我们的服务器；
滥用免费额度（如自动化识别或创建多个设备标识绕过限制）；
将 App 用于任何非法目的。

5. 你的内容与隐私

你保留对照片的权利。 Catchdex 不主张对你选择识别的照片的所有权。
我们不保存识别照片。 照片在内存中处理后即释放，详见隐私政策。
提升识别准确度。 作为运营服务的一部分，我们可能保留约 5% 你确认入册的照片、以及服务端判定为「图中无鱼」的照片作为负样本，最长 90 天用于改进 AI。你授予我们有限的许可，仅用于提升识别准确度。你可通过 support@dagvisio.com 要求删除已收集内容。
你在反馈表单中主动上传的图片：若你在反馈消息中附上最多 9 张图片，我们保留这些图片用于人工核查你的反馈，最长 90 天后安排删除。上传前会剥离位置（GPS）与 EXIF 等全部隐藏信息。
请勿上传敏感信息。 不要使用识别功能上传财务账号、身份证件、可识别的他人照片或健康信息。你自行承担所发送内容的后果。

6. 购买与订阅

当前状态：Catchdex 无任何购买或订阅，服务免费并提供月度额度。

未来若推出付费计划，我们将更新本条款并在 App Store 页面披露价格。支付将由 Apple 通过 App Store 处理，我们不会接触你的支付卡信息。续订、退款与取消遵循 Apple 政策。

7. 知识产权

Catchdex App、其设计、图鉴百科与识别服务归开发者所有。所有鱼种插画（hero images）均为 Catchdex 原创美术作品，受版权保护。图鉴中未使用任何第三方图片。

8. 免责声明

App 按「现状」及「现有可用性」提供，不作任何明示或默示保证，包括但不限于适销性、特定用途适用性、识别结果准确性或不侵权的保证。我们不保证 App 不会中断、无错误或安全，也不保证识别结果正确。部分司法辖区不允许排除某些保证，因此部分排除可能不适用于你。

9. 责任限制

在适用法律允许的最大范围内，我们不对任何间接、附带、特殊、后果性或惩罚性损害，以及利润、数据或商誉损失承担责任。我们对与本 App 相关的全部索赔的总责任不超过：(A) 你为使用本 App 支付的金额，或 (B) 适用法律允许的最大金额，取较高者。由于 Catchdex 目前免费，这实际上意味着在适用法律允许的最大范围内，我们的责任以适用法律允许的最大金额为限。部分司法辖区不允许限制或排除特定损害的赔偿责任，因此部分限制可能不适用于你。

10. 变更与终止

我们可能不时更新本条款。发生重大变更时，我们将在此发布更新版本并标注新的「最后更新」日期，并在可行时于 App 内通知你。变更后继续使用即表示你接受更新后的条款。

你可随时停止使用 Catchdex。若你违反本条款或滥用服务，我们可暂停或终止你的访问。

11. 准据法与争议解决

本条款受开发者所在司法辖区法律管辖，不适用冲突法规则。我们建议你先联系我们——多数问题一封邮件即可解决（support@dagvisio.com）。我们不强制仲裁，本条款不阻止你向有管辖权的法院寻求救济（包括适用的小额索赔法院）。若你所在司法辖区的消费者保护法赋予你强制性保护，本节不限制该等保护。

12. Apple 要求

若你通过 Apple App Store 获取 Catchdex，以下条款适用：

本条款仅在你与开发者之间成立，与 Apple 无关；
Apple 无义务提供任何维护或支持，如有问题请联系我们而非 Apple；
在适用法律允许的最大范围内，Apple 对 App 不承担保证义务；
若 App 不符合适用保证，你可通知 Apple，Apple 将退还你支付的购买价款（如有），除此之外 Apple 无其他义务；
Apple 不负责处理你的索赔或任何第三方与本 App 相关的索赔（包括产品责任、不符合法律或监管要求、知识产权侵权）；
Apple 及其子公司是本条款的第三方受益人，你接受本条款后，Apple 有权以第三方受益人身份对你执行本条款。

13. DMCA / 版权

我们尊重知识产权。如你认为 App 中内容侵犯了你的版权，请向 support@dagvisio.com 发送包含以下内容的通知：

你的签名（实体或电子）；
被指侵权的版权作品标识；
被指侵权材料的标识及其位置；
你的联系方式（地址、电话、邮箱）；
你善意认为该使用未经授权的声明；及

我们将依据适用法律（含美国《数字千年版权法案》17 U.S.C. § 512）对有效通知作出响应。
